AHMEDABAD, GUJARAT : In a significant legal reform, the Chief Metropolitan Court of Ahmedabad will be renamed the Judicial Magistrate Court, Ahmedabad city. Similarly, the Additional Chief Metropolitan Magistrate Court will be re-designated as the Additional Chief Judicial Magistrate, Ahmedabad city. This change, as per public notices issued by the Legal Department of the state, will come into effect from July 1, 2024.

The rebranding of these courts is a direct result of the new Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which will replace the existing Criminal Procedure Code (CrPC) starting July 1, 2024. The BNSS does not include provisions for terms like Metropolitan City, Metropolitan Court, or Metropolitan Magistrate. Consequently, the Legal Department, acting on the recommendations and advice of the Gujarat High Court, has initiated these changes to align with the new legal framework.

Ahmedabad boasts a comprehensive network of courts, ensuring efficient legal proceedings and law enforcement across the city. The jurisdiction of Ahmedabad’s Metropolitan Magistrates’ Courts, now the Judicial Magistrate Court, aligns with the respective jurisdictions of police stations throughout the metropolitan area, facilitating streamlined legal processes.

The primary Judicial Magistrate Court complex is located at Gheekanta and houses 25 courts dealing predominantly with cases under the Indian Penal Code (IPC). In addition to this main complex, there are 12 special courts dedicated to cases under the Negotiable Instruments Act, temporarily situated at the MS Building Complex in Lal Darwaja.

The Juvenile Justice Board operates near Cama Hotel in Khanpur, Ahmedabad, alongside the adjacent Remand Home, and is overseen by a designated Judicial Magistrate. These specialized courts play a crucial role in handling juvenile cases, ensuring that minors receive appropriate legal treatment and protection.

Further, two Judicial Magistrates are assigned to Municipal Courts within the Ahmedabad Municipal Corporation Building at Danilimda. These courts handle cases related to various regulatory acts, including those involving food adulteration, explosives, and birth and death registration. These specialized municipal courts ensure that city regulations are enforced and that public health and safety standards are maintained.

A Mobile Court, stationed at Kankaria, Ahmedabad, and overseen by a Judicial Magistrate, addresses cases related to health and sanitation. This mobile facility ensures that legal services are accessible to the public and that health and sanitation issues are promptly addressed.

The re-designation of these courts marks a significant shift in the judicial landscape of Ahmedabad. “This change is essential to comply with the new BNSS framework and reflects our commitment to modernizing our legal system,” stated a representative from the Gujarat High Court. “It will ensure that our judiciary is aligned with contemporary legal standards and practices.”
