Surat Charity Commissioner Orders Site Inspection of SGCCI’s Six-Storey Building

Surat : The Surat Charity Commissioner has issued orders for the site inspection of a six-storey building constructed by the Southern Gujarat Chamber of Commerce and Industry’s (SGCCI) trade and industry development centre at Sarsana in Surat on May 25, 2023.

This decision comes after Sanjay Ezhawa, a vigilant social activist, filed an objection application with the Joint Charity Commissioner regarding the approval sought for selling the floors and offices of the building by the Southern Gujarat Chamber’s Trade and Industry Development Centre in 2021.

The land, measuring a substantial 1.18 lakh square meters, was allotted by the Gujarat Government on a relief basis for the development of trade and commerce to the SGCCI’s trade and industry development centre back in 2006. With the permission of the district collector and the Joint Charity Commissioner, the SGCCI went ahead with the construction of the pillar-less dome and convention center on this land.

However, it has come to light that no permission was sought for the construction of the six-storey ‘C Building,’ which has subsequently been sold to various organizations at a rate of Rs 2,500 per square foot for a 99-year lease period.

“The Surat Charity Commissioner’s decision to conduct a site inspection of the disputed building is a welcome move. It highlights the importance of adhering to proper procedures and regulations in the realm of construction and land development. The charitable trust that oversees the activities of the SGCCI is entrusted with the responsibility of utilizing the land for the betterment of trade and industry. Any deviation from the approved plans and unauthorized sale of parts of the property raises serious questions about the trust’s compliance and accountability” said Ezhawa.

Sanjay Ezhawa, in his objection application, has pointed out the need for transparency and adherence to legal requirements in such matters. By raising his concerns, he has brought attention to a potential violation of the trust’s obligations and has rightfully sought intervention from the authorities. The Charity Commissioner, being the regulatory body responsible for overseeing the functioning of charitable trusts, has a crucial role to play in ensuring that the interests of the public and the purpose for which the land was allotted are protected.

The larger issue at hand is the preservation of the public’s faith in charitable organizations and their activities. Charitable trusts are established to serve a noble cause and contribute to the welfare of society. Hence, it is imperative that they operate with utmost integrity, adhering to the letter and spirit of the law. Any deviation from this path erodes public trust and undermines the credibility of the entire charitable sector.

The outcome of the site inspection will determine the way forward. If any irregularities are found, appropriate actions, such as penalties or legal consequences, should be taken against the responsible parties. It is essential for the Surat Charity Commissioner to conduct a thorough and impartial investigation, ensuring that justice is served and any misconduct is appropriately addressed.
