GST Tribunal to Open Soon in Surat

Surat : Surat, known as India’s diamond city, is set to establish a Goods and Services Tax (GST) Appellate Tribunal within the next six months, a significant relief for the region’s traders and industrialists. The search for a suitable location has been completed, and authorities are moving swiftly to finalize its setup, aiming to make the tribunal operational by mid-2024.

The establishment of GST Appellate Tribunals was originally envisioned with the implementation of the GST regime on July 1, 2017. However, it wasn’t until July this year that the GST Council granted final approval to these tribunals, marking a crucial step forward for industry stakeholders who have long been awaiting a dedicated forum to resolve GST disputes. Up until now, traders and business owners had to approach higher courts, such as the Gujarat High Court or the Supreme Court, to settle their cases, a time-consuming and costly process.

The upcoming GST tribunal will be part of a broader initiative by the Ministry of Finance, which in September announced the formation of 31 GST Appellate Tribunals across 28 states and eight Union Territories. This move aims to address a rising number of disputes between taxpayers and the Revenue Department, as stakeholders have voiced their concerns over the growing backlog and delays in tax-related litigation.

In Gujarat, new tribunals are set to open in Surat, Ahmedabad, and Rajkot. The local tribunal in Surat is expected to significantly streamline dispute resolution for traders in the region, who previously had to travel to Ahmedabad to resolve GST cases. According to authorities, the creation of the tribunal will help address long-standing demands of the business community, allowing faster, more localized access to legal recourse.

Meanwhile, the GST landscape in Gujarat has seen increased enforcement activity. Recently, the state’s GST department conducted raids on eight jewelers in Surat, including establishments such as Kalamandir, Bishan Dayal, Pachchigar, Dagina, Gehena, Nakrani, and Mahaveer jewelers. These raids were carried out on suspicions of gold sales without proper billing, hinting at significant tax evasion. Authorities have indicated that further investigations are likely, with additional inspections expected in the near future for other jewelry businesses.

The Enforcement Directorate (ED) has also intensified its scrutiny on fraudulent tax practices across the state. Over 200 bogus firms registered in Gujarat have been identified for issuing fake invoices, generating bogus input tax credits, and amassing significant tax evasion. This past week, ED teams conducted raids on seven locations in Ahmedabad, Surat, and Bhavnagar, seizing crucial documents, bank accounts, and financial records. These actions followed a major operation last week, when ED officials raided 23 locations simultaneously, confiscating transaction records from 200 fraudulent companies. The ongoing investigations have also targeted entities associated with M/s Dhruvi Enterprises.

With the establishment of the new GST tribunal, industry players in Surat can expect a more accessible and efficient system to address tax disputes. The tribunal’s arrival is set to enhance compliance and bring greater stability to the region’s economic landscape, supporting business growth while ensuring accountability within the GST framework.
