Ahmedabad | Gujarat — Former Indian cricketer and Trinamool Congress (TMC) MP Yusuf Pathan has suffered a major legal blow in a long-running property dispute. The Gujarat High Court has upheld a notice issued by the Vadodara Municipal Corporation (VMC), which declared him an “encroacher” on a government-owned residential plot adjacent to his bungalow in the city’s Tandalja area.

Justice Mauna Bhatt, delivering the judgment, dismissed Pathan’s plea challenging the VMC’s 2024 order. The court made it clear that “celebrity status cannot be a shield against the law” and warned that granting exceptions in such cases would set a damaging precedent for society.

A Dispute Stretching Over a Decade

The controversy began in 2012, when Pathan sought to purchase an open residential plot next to his property. He argued that as an international cricketer, the acquisition was necessary for “security reasons.” However, in 2014, the VMC rejected his application after evaluating the property.

Despite the rejection, Pathan allegedly continued occupying the plot. Civic authorities maintained that this amounted to encroachment on government land.

Legal Wrangle After Political Debut

The dispute resurfaced in 2024, shortly after Pathan was elected as a Member of Parliament from Baharampur in West Bengal on a TMC ticket. The VMC then issued a formal notice directing him to vacate the land. Pathan challenged this notice in the Gujarat High Court, but the court has now upheld the civic body’s order and directed that the encroachment be removed.

Court Rejects ‘Special Treatment’ Argument

In her ruling, Justice Bhatt underscored that the law applies equally to all, regardless of status. “If exceptions are made for celebrities or public figures, it would erode faith in the rule of law,” the judgment observed. The court also reinforced that government property cannot be held or occupied without due process, no matter how genuine the personal reasons may appear.

What the Ruling Means

The High Court’s decision paves the way for the Vadodara Municipal Corporation to take direct action and clear the disputed land. Legal experts say this ruling could set an example for similar cases where influential individuals occupy public property without proper authorization.

Local civic officials, speaking on condition of anonymity, said the verdict “strengthens the message that even powerful figures must comply with municipal regulations.”
