Gujarat Government Fixes Accountability for Man-Made Disasters

Gandhinagar:  Following man-made disasters across the state, the Gujarat Government has altered the Gujarat State Litigation Policy to hold top officials responsible in a major move. The decision follows the terrible fire catastrophe at the Rajkot Game Zone on May 25, 2024, which killed numerous people one month ago. Particularly the Congress, the victims and opposition parties have claimed that only junior officials are being brought accountable while senior authorities go unpackled.

Under Chief Minister Bhupendra Patel, the state cabinet authorized some significant changes to the litigation policy, which has been in effect since 2011. Emphasizing that the modifications seek to close gaps found through frequent inspections and several High Court rulings, Spokesperson Minister Rishikesh Patel announced the changes.

The clause allowing officers to be liable fixes one of the main changes to the policy. This proposal seeks to guarantee that in situations whereby the government has great advantages but fails due to officer negligence or inadequate information, the accountable responsible officers will be held liable. The state government plans to act against officials who, by carelessness, help to produce negative results.

The policy now includes clauses allowing for decisive action in case of a dispute between the Law Division’s decision and the proposing department, therefore addressing delays in the appeals procedure. Such conflicts are resolved by a committee headed by the Chief Secretary of the State Government. Additional members comprise the Secretary of the proposing department, General Administration Department Secretary, Law Department Secretary, and Finance Department Secretary.

A high-level commission established by the Gujarat government is tasked with supervising these new clauses and guarantees their efficient use. This committee will also be able to act against officials discovered to have shielded guilty parties by means of weak court appearances. This new control system is meant to guarantee responsibility at all levels and stop departmental staff from carrying biassed investigations.

Minister Rishikesh Patel underlined that these changes will allow quick observation of cases favorable to the government, therefore reducing delays-induced losses. Apart from guaranteeing efficient handling of defaulters, the updated litigation policy is supposed to save time, money, and resources. The government thinks that this strategy will result in more open and effective treatment of legal issues concerning man-made disasters.

The adjustments have been proposed under mounting political and public demand. Following the Rajkot Game Zone fire, calls for stricter policies and responsibility have grown as Leaders in Congress and the relatives of victims have been outspoken about their worries about the real offenders being covered-up. This legislative modification by Gujarat Government is considered as a first step towards resolving these complaints and rebuilding public confidence in the administrative apparatus of the state.
