Bhiwandi company director sent to Lajpore jail in Rs.10 lakh cheque bounce case

SURAT : A director of a Maharashtra-based company has been sent to Lajpore Central Jail, Surat, after a court rejected his plea seeking cancellation of a Non-Bailable Warrant (NBW) in a cheque dishonour case involving financial transactions worth crores of rupees.

The accused, identified as Kailashkumar Satyanarayan Khator, had approached the Chief Judicial Magistrate Court in Surat through his advocate seeking relief. However, the complainant opposed the application, arguing that the accused had allegedly avoided court proceedings for nearly five years.

Senior Advocate Naresh Gohil, representing the complainant, submitted that a person who repeatedly remains absent from legal proceedings cannot seek cancellation of an NBW without personally appearing before the court.

“The accused must first submit to the jurisdiction of the court before seeking cancellation of the warrant,” Gohil argued.

Accepting the objection, the court directed the accused to appear personally. After hearing both sides, Chief Judicial Magistrate M.N. Pathar rejected the application and ordered judicial custody at Lajpore Central Jail.

The case was filed by Accurate Transheat Pvt. Ltd., Sachin, Surat, a manufacturer of textile dyeing and printing machinery. The company claimed that Khator Fibres & Fabrics Ltd. had purchased machinery and spare parts worth around ₹4.63 crore but failed to clear outstanding dues.

The company had issued multiple cheques towards the pending liability, but they were dishonoured. Following this, cases were filed under the Negotiable Instruments Act against the company and its directors.

Police later initiated execution proceedings after court directions, leading to Khator’s appearance before the court.
